General terms and conditions of sale

Introduction

This document is produced as part of the online sales activity of Good-Shoot, a company domiciled at 39 avenue de la république 94100 Saint Maur des Fossés, registered under the number 45378121300013.

These general terms and conditions of sale include the compulsory information stipulated in articles R111-1 et seq. of the French Consumer Code.

The general terms and conditions of sale described below detail the rights and obligations of Good-Shoot and its customers.

All users of this website are required to consult the general terms and conditions of sale on a regular basis and to read them before making any payment. This document constitutes a contract of adhesion and binds the customer to Good-Shoot once accepted.

The applicable law in the context of these general terms and conditions of sale is French law, exclusively, to the exclusion of any other foreign element that may give rise to a conflict of law or international jurisdiction. Only French courts will have jurisdiction in the event of a dispute.

In order to modify or update its customer area or sensitive data, Good-Shoot may request confirmation of identity, in the most appropriate form.

In the event of an international purchase or sale, the provisions of French law shall remain applicable.

1. Scope of application

These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the Good-Shoot online shop.

2. Contracting party and conclusion of the Contract

The presentation of the Products on the Good-Shoot merchant site does not constitute a legally binding offer but a non-contractual online catalogue. For technical reasons, colours may vary between the original Products and their image. You can, without any obligation to purchase, place items in your basket and then add or remove them at any time using the modification tools provided for this purpose, which are explained to you at each stage of the order process. By clicking on “Place order”, you validate the contractual order for the items contained in the basket. You will receive a confirmation email acknowledging receipt of your order. If you have chosen to pay for your order in advance, you will be informed of the acceptance of your order in the order confirmation email.

If the Product ordered is out of stock, unavailable or sold out, you will be informed immediately. If delivery is temporarily impossible, and if the situation allows, the Product(s) ordered will be reserved. If the Product is sold out, you may cancel your order.

3. Payment and delivery terms

3.1 Payment

To obtain Good-Shoot products, payment must be made at the prices indicated when the request is validated on the website.

The price range is as shown on this page.

Good-Shoot accepts the following methods of payment:

  • Credit card
  • PayPal

Payment is due immediately on the order date, including for pre-ordered products. Secure online payment by credit card is made through Stripe. The information transmitted is encrypted and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of Stripe and cannot be imputed to us.

Good-Shoot reserves the right to change its prices at any time.

3.2 Delivery

Delivery charges may be added to the displayed price of the Products.
For international deliveries, the Customer must pay any additional taxes, fees and customs duties that may apply.
Good-Shoot sends its parcels by post within 7 days of the Customer placing the order.

3.3 Order changes and return conditions

As long as the product has not been dispatched, the Customer may contact Good-Shoot to cancel the order. Good-Shoot will refund the full amount paid by the Customer.

Returns are accepted and at the Customer’s expense. If the returned Products are not damaged, Good-Shoot will refund the Customer the amount of the Products without the delivery costs.

4. Reservation of ownership

The Products remain the property of Good-Shoot until full payment has been received.

5. Damage during transport

If the Products have suffered obvious damage during transport, please file a claim with the delivery service as soon as possible and contact Good-Shoot promptly. This will enable Good-Shoot to act more effectively vis-à-vis the carrier and/or insurer.

6. Guarantees

Unless otherwise expressly agreed, the statutory warranty rights apply.

8. Liability

Good-Shoot’s liability is limited to the value of the Product. Good-Shoot shall not be liable for minor and unintentional breaches of negligible contractual obligations. The above limitations of liability do not apply in the event of personal injury, illness or death for which Good-Shoot is liable.

9. Underage

The Products offered in our online shop are only intended for Customers aged 18 or over.

10. Personal data

Good-Shoot undertakes to process the personal data of its customers for professional purposes and to process orders.

Customers have the right to access, rectify, port and delete their data, or to limit processing, in accordance with the amended “Data Protection” Act of 6 January 1978 and European Regulation no. 2016/679/EU of 27 April 2016 (applicable from 25 May 2018). Any complaint on this subject should preferably be made directly to Good-Shoot, in order to find an appropriate solution.

In the event of a dispute, the customer may freely report it to the CNIL, with the legal information in their possession on the identity of Good-Shoot in the Preamble to these general terms and conditions of sale.

The duration of conservation and use of the personal data will not exceed 3 years, as from the first obtaining of these last ones. Please consult the confidentiality policy, provided for this purpose, available on the website on this page.

11. Disputes

11.1 Complaints

In the event of a dispute between Good-Shoot and one of its customers, the latter must send a complaint in writing (email or post). Good-Shoot has 72 hours to respond in writing. If the customer is not satisfied with the proposed solution, the parties will endeavour to find a favourable outcome, out of court, before any legal proceedings.

11.2 For a contractual dispute

In the event of a dispute, professional customers undertake to seek amicable settlement before any legal proceedings. Non-professional customers may refer disputes free of charge to the mediation centre competent to deal with disputes for which the Service Provider is responsible: contact details to follow.

In all these cases, disputes and litigation must remain strictly confidential and may not be the subject of a media crisis caused by one of the parties. In the event of a dispute, and in the absence of an amicable solution, the competent court is that of the Provider’s Court of Appeal, unless otherwise provided by law.
